Abstract

This article departs from the construction of the limits of sovereignty in its relationship with the economy and the Law. To this end, based on eminently bibliographic research, it focuses on the theories mobilized by Michel Foucault. Homo oeconomicus emerges as a central concept in this work, since it is through its historicization that the limits of sovereignty, its relationship with the concept of homo juridicus, as well as the construction of a new rationale for the world will be analyzed. The new homo oeconomicus of neoliberalism does not impose limits or destitutions on the sovereign, but rather a new governmental logic that spreads across various areas of the State, including the Judiciary. As a result, it is found that neoliberalism promotes a dispute over the model of the State, which occurs through legal practitioners who begin to identify with the homo oeconomicus.
