https://periodicos.ufn.edu.br/index.php/disciplinarumSA/article/view/5262

This article aims to carry out an analysis of how the social platform Discord, object of this investigation, its Terms of Service and Community Guidelines manifests as a digital environment that facilitates the production and dissemination of pornography against Brazilian children and adolescents. Several bibliographic, documentary, and normative sources were used, as well as a brief study about Discord’s functioning, and the analysis of a specific case that received notoriety throughout the media. The approach method used was deductive, because firstly is highlighted the different types of sexual violence against children and adolescents, to then have child pornography on Discord analyzed specifically. Besides, the monographic procedure method was used, as it is observed how sexual violation against these subjects of rights is established and proliferates on Discord. The investigation aims to answer the following question: to what extent does the way Discord platform operates, through its Terms of Service and its operating structures, contributes to the production and dissemination of child pornography in Brazil? Thus, it appears that the very own structure of the application and its means of communication, provided for users to interact, as well as the delegation of responsibility of Discord to third parties and the absence of legal representation in Brazil, contributes to the production and dissemination of child pornography.
Júlia da Rosa BicoRosane Leal da Silva

https://periodicos.ufn.edu.br/index.php/disciplinarumSA/article/view/17-27

The article explores the challenges and role of artificial intelligence (AI) in the legal field, with an emphasis on the automation of routine tasks in law firms. The goal is to investigate how AI, especially through deep learning, can automate activities such as drafting and filing petitions, allowing lawyers to focus on more complex analyses. Specifically, the study aims to: (1) identify practical applications of AI in the legal field; (2) evaluate the benefits and limitations of these applications; and (3) reflect on the ethical aspects involved. The methodology adopted is deductive, based on a literature review on AI, including the distinction between strong and weak AI and its practical use in the legal environment. The study also highlights the use of the “robot lawyer” Ross, already operating in law firms in the United States. The results indicate that AI provides significant improvements in the efficiency of repetitive tasks, but also raises ethical concerns, such as a lack of transparency and potential discrimination in algorithmic decisions. These issues highlight the need for caution in the use of AI, since, although the technology is promising, it cannot fully replace the human role in the legal process. Only human beings are capable of creating the data that feeds AI systems and of dealing with unforeseen decisions that require critical reflection. The study concludes that, for the responsible and ethical use of AI in Law, it is essential to balance the automation provided by algorithms with human intervention, ensuring that decision-making preserves justice and equity in the legal context.
Patrícia Adriani HochSamuel NascimentoVitalínio Guedes

https://periodicos.ufn.edu.br/index.php/disciplinarumSA/article/view/5347

The PSOL proposed the ADPF 828 toward the STF in order to cease injury or threat of injury to the fundamental social right to housing in the context of serious vulnerability caused by the COVID-19 pandemic. After the improvement of the epidemiological situation, on October 21, 2022, the Rapporteur Minister Luís Roberto Barroso issued a decision in which he endorsed the fourth provisional relief granted in ADPF 828 and ordered the Courts of Justice and the Federal Regional Courts to implement Land Conflict Commissions capable of seeking consensual solutions to collective land conflicts. In view of this time lapse, the scientific article aims to analyze the mediation of collective land conflicts carried out by the Land Conflict Commissions in the Courts of the Southern Region of Brazil to answer the following problem: were the Land Conflict Commissions determined in a judicial decision rendered in the records of ADPF 828 implemented by the Courts of Justice and the Federal Regional Court of the Southern Region of Brazil? If so, are they mechanisms capable of mediating collective land conflicts? To this end, the methods of deductive approach, bibliographic procedure and indirect documentation research technique were used. In the end, it was possible to conclude that the commissions were implemented by the Courts analyzed, they act as auxiliaries to the Magistrate and are mechanisms capable of mediating urban or rural collective land conflicts before the initiation of judicial proceedings and at any stage of the process.
Ana Vitória Lucero da SilvaHígor Lameira Gasparetto

https://periodicos.ufn.edu.br/index.php/disciplinarumSA/article/view/5426

This study aimed to analyze the effects of the formalization of Individual Microentrepreneurs (MEI) in the clothing sector in Passos, Brazil, using the SWOT analysis framework. The qualitative research employed unstructured questions to examine the internal and external factors affecting microentrepreneurs. The results indicated that formalization offers benefits such as increased market credibility, access to social security benefits, facilitated credit, and improved fiscal organization. However, challenges were identified, including the obligation to pay the Simples Nacional tax (DAS) during periods of low demand and the sector’s seasonality. It was also found that regularization is associated with opportunities for expansion and profitability, while the lack of financial planning and dependence on continuous services pose potential threats. The study concludes that, although essential for strengthening the sector, formalization requires ongoing support through training and tax incentives.
Marcus Vinicius Rodrigues SilvaGustavo Clemente ValadaresJúlio Cézar da SilvaJoão Francisco Sarno CarvalhoAlyce Cardoso CamposJoyce da Cruz Teixeira

https://periodicos.ufn.edu.br/index.php/disciplinarumSA/article/view/5515

In this paper, aim to investigate the possibilities of combating the stalemates of representative democracy in Brazil, especially through the ideas of the indoctrinators Paulo Bonavides and Leonardo Avritzer. The first addresses the idea of participatory representative democracy, where the people have a key role as an active political subject. Instruments will also be analyzed for the population to have greater power to participate in political decision-making, such as the mechanisms exposed in art. 14 of the Federal Constitution of 1988, among others that will be studied. The second author proposes measures of political reform that aim to combat these impasses. Thus, the central problem arises: can participatory democracy, through greater popular engagement in political decision-making, provide an answer to the impasses and crises experienced by Brazilian democracy? Accordingly, the aim is to highlight the importance of popular participation for the protection and expansion of democracy in Brazil and the pursuit of an active citizenship, a citizen action that goes beyond merely voting, with the answer being yes: participatory democracy can indeed address these impasses. This work is based on the deductive method of analysis, primarily through bibliographical research, as well as documentary sources.
Marcos Antunes Kopstein

https://periodicos.ufn.edu.br/index.php/disciplinarumSA/article/view/5514

This article analyzes the possibilities of using generative artificial intelligence in the fields of education and communication, with an emphasis on promoting digital literacy among teachers and advertisers. The study is based on the growing impact of digital technologies and the need for ethical and critical training for their use. Its main objective is to contribute to the digital literacy of educators and communicators regarding the use of these tools. Specifically, it seeks to identify applications of generative AI in educational and communicational contexts, explore their strategic potential, assess their limitations, and foster more effective pedagogical and communicational practices. The theoretical framework draws on authors such as Coscarelli, Rojo, Kaufman, and Santaella, discussing concepts of digital literacy, generative AI, and technological ethics. The adopted methodology is qualitative, exploratory in nature, and structured in four main stages: literature review, tool mapping, practical implementation, and result analysis. Three generative AI platforms - ChatGPT, Duolingo, and Shakker.ai - were selected and analyzed according to criteria such as accessibility, functionality, and pedagogical applicability. The results indicate that these tools, when used critically and strategically, can expand teaching and communication possibilities, fostering more interactive, personalized, and creative practices. Furthermore, the analysis highlights the importance of ethical and critical use of these technologies, considering risks such as data bias, cultural limitations, and issues of digital authorship. It is concluded that technical mastery combined with ethical training is essential for the effective use of these technologies, and further empirical studies in educational and advertising contexts are recommended.
João Vithor de Freitas SandersTaís Steffenello Ghisleni
